Use of Site Terms & Conditions 

BrightBird Coaching & Training maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and BrightBird Coaching & Training. If you do not agree to these terms, do not use this Site. 

 

1. Use of Site, Copyright & Intellectual Property 

BrightBird Coaching & Training provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”).  

 

BrightBird Coaching & Training authorizes each User to view and download one copy of the Materials. Materials may be downloaded and a maximum of one copy of the Materials may be printed provided that Users make no modifications to the Materials and you retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials.  

 

Users may not modify the Materials at this Site in any way or reproduce, share or distribute them.  Anyone wishing to share materials should contact BrightBird Coaching & Training and request a licence for further distribution. This will be subject to agreement of a fee and BrightBird Coaching and Training retains the right to decline to provide said licences for any course/materials as it sees fit. 

 

Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site. 

All Intellectual Property Rights in or arising out of or in connection with the contract and in the materials shall be owned by BrightBird Coaching and Training and nothing in the Contract shall grant you any Intellectual Property Rights. 

Terms and conditions relating to Intellectual property shall survive termination of the Contract. 

 

2. Geographic location 

If you, as a User, purchase Materials from this Site or BrightBird Coaching & Training while outside of the UK, please note that all terms and conditions will remain.  All training times will be UK(London) time. 

 

3. Hyperlinks 

Links to external websites are provided solely as a convenience to you. BrightBird Coaching & Training has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. If you decide to access any of the external websites linked to this Site, you do so entirely at your own risk. 

 

4.  Payment, Cancellations & Refunds 

Payment must be made in full, or part thereof if stated in individual training T&C’s before access will be given to any courses.  Should an invoice required, the person booking must state they are authorised to make said booking/payment on the booking form. 

 

We are unable to refund for non-attendance of our courses, workshops or programmes. 

 

Cancellations of less than 7 calendar days, will result in a charge for the full cost of the course/coaching session.  Should a customer wish to reschedule their training booking however, they will incur no loss if this is agreed at least 7 calendar days before the original training date. 

 

Bright Bird is continually appraising and improving services and reserves the right to alter any course or workshop content without prior notice. Every effort will be made to provide their services as stated. 

Bright Bird reserves the right to withdraw any courses, workshops, programmes or coaching services at any time. 

 

In the event of unforeseen circumstances on Bright Bird’s part, leading to the cancellation of a booked course, workshop, coaching session or programme, you will be offered an alternative date at no extra cost, or the return of your fee/deposit. 

 

It is the User’s responsibility to ensure they can attend any training booked, including multi-session programmes.  Once a programme has commenced, the User will not be entitled to a refund either in full or in part. 

 

5.  Registration 

Registration links are for the sole use of the individual booked onto the course and are not in any circumstances to be shared with any other third party.  (See also Section 1 above)  BrightBird Coaching & Training reserves the right to cancel any access/registration to training and the Website should they have reasonable grounds to believe this condition has been infringed.  This may result in loss of fees for the User. 

 

6. No Warranty 

The Materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. BrightBird Coaching & Training further does not warrant the accuracy and completeness of the Materials at this Site. BrightBird Coaching & Training may make changes to the Materials at this Site, or to the services and prices described in them, at any time without notice. The Materials at this Site may be out of date, and BrightBird Coaching & Training makes no commitment to update the Materials at this Site. 

 

7. Limitation of Liability 

In no event will BrightBird Coaching & Training, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever arising out of the use or inability to use this Site, any websites liked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof. 

All work undertaken by BrightBird Coaching & Training is covered by Public Liability and Professional Indemnity insurance. 

 

All coaches are certified, undertake regular supervision as professional coaches and adhere to the European Mentoring and Coaching Council (EMCC) code of professional practice. 

 

Where necessary, BrightBird Coaching & Training works with other associates from variety of backgrounds, to bring further skills and experience to our clients.   Our associates share an enthusiasm for coaching and development and hold the same commitment to delivering professional, high-quality service.  All associates hold appropriate professional qualifications and experience and necessary liability cover and commitment to CPD. 

 

8. Applicable Law 

The Terms of Use are governed by the laws of the United Kingdom. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. BrightBird Coaching & Training may assign its rights and duties under the Terms of Use without notice to any party at any time. 

 

9. Effective Date and Updates 

The Terms are effective as of 23rd August 2020 and are subject to change without notice by BrightBird Coaching & Training at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
